These Terms of Service (the "Terms") govern your use of our website(s), mobile apps, and any related online or offline products, services, and experiences (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. Please read them carefully before using the Services.

1. Acceptance of Terms

By accessing or using the Services, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree to these Terms, please discontinue using the Services.

2. Use of Services

1. Personal, Non-Commercial Use
   The Services are intended for personal, non-commercial use. You may not use the Services for any illegal or unauthorized purpose, and you agree to comply with all applicable laws and regulations while using the Services.
2. Restrictions
   • You shall not engage in any activity that could harm, disrupt, or interfere with the functioning of our Services.
   • You shall not bypass any security measures or attempt to gain unauthorized access to any portion of our Services.

3. Donation Terms

1. Processing of Donations
   • Sebaste is a registered 501(c)(3) non-profit organization. Donations made through our Services are tax-deductible to the extent allowed by law.
   • All donations are processed through secure third-party payment processors. By making a donation, you agree to comply with the terms and policies of these payment processors.
   • You represent and warrant that you are authorized to use any payment method you provide.
2. Donation Acknowledgments
   • For donations of $250 or more, we will provide a written acknowledgment for tax purposes as required by law.
   • You are responsible for providing accurate contact information to receive acknowledgments and tax receipts.
3. Refund Policy
   • All donations are final and non-refundable. However, if you believe an error has occurred in your donation, please contact us at info@sebaste.org within 30 days.
   • In cases of demonstrable error or fraud, we will review refund requests on a case-by-case basis.
4. Recurring Donations
   • If you set up a recurring donation, you authorize Sebaste to charge your payment method on a recurring basis until you cancel.
   • You may cancel recurring donations at any time by logging into your account or contacting us at info@sebaste.org.

4. Intellectual Property

1. Ownership
   All content within the Services, including but not limited to text, graphics, logos, images, videos, software, and designs, is owned or licensed by Sebaste and is protected by intellectual property laws.
2. Prohibited Uses
   You may not copy, modify, distribute, transmit, display, perform, or create derivative works from any content on the Services without our prior written consent.

5. User Content

1. Submission of Content
   • You may have the opportunity to submit content to our Services (such as comments, testimonials, or stories). By submitting content, you grant Sebaste a worldwide, non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content.
   • You represent and warrant that you own or have the necessary rights to the content you submit and that it does not violate the rights of any third party.
2. Content Guidelines
   • User-submitted content must not be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
   • We reserve the right to remove any user content at our sole discretion without notice.

8. SMS Messaging Terms & Conditions

Sebaste may offer messaging services ("Messaging Services"), including automated text messages for informational or marketing purposes, including donation requests, confirmations, and receipts. By opting in, you agree to the following terms:

1. General
   • When you opt-in, we will send you a confirmation message.
   • By opting in, you consent to receive recurring automated marketing and informational text messages from Sebaste, which may be sent via an automatic telephone dialing system, to the mobile number you provide.
   • Message frequency may vary based on your interaction with Sebaste, typically not exceeding 4 messages per month. We reserve the right to alter the frequency or suspend/cancel the Messaging Services at any time.
2. Consent
   • Your consent to receive these messages must be provided through an affirmative act, such as checking a clearly labeled opt-in box or sending a specific keyword to our number.
   • Your consent to receive these messages is not a condition of any purchase or donation.
   • Standard message and data rates may apply. If you have questions about your data plan, contact your mobile provider.
3. Carriers
   • Mobile carriers are not liable for delayed or undelivered messages.
   • Our Messaging Services are supported by most major carriers, including AT&T, T-Mobile, Verizon, Sprint, and others.
4. Cancellation
   • You can unsubscribe at any time by replying "STOP" to any message we send or by clicking any included unsubscribe link (when applicable). Once you confirm your unsubscription, no further messages will be sent.
   • If you decide to opt back in after unsubscribing, just sign up again through our usual registration process.
5. Help or Support
   • For support, contact info@sebaste.org, or text "HELP" to the number provided in our messages.
6. Transfer of Number
   • If you change or transfer your mobile phone number, you must reply "STOP" from your old number or notify us at info@sebaste.org.
7. Verification
   • By providing your mobile number and opting in, you represent that you are the account holder for that number or have authorization from the account holder to opt in.
   • We may use additional verification methods to confirm your consent as required by law.
8. Messaging Terms Changes
   • We reserve the right to modify or discontinue our Messaging Services or update these messaging terms at any time. Any changes are effective immediately upon posting. If you do not agree to the new terms, you should discontinue use of the Messaging Services.

9. Disclaimers

1. "As Is" and "As Available"
   The Services are provided on an "as is" and "as available" basis. Sebaste makes no representations or warranties of any kind, express or implied, regarding the operation or availability of the Services.
2. No Warranty
   We do not warrant that the Services will be error-free, uninterrupted, secure, or that any defects will be corrected. Your use of the Services is solely at your own risk.

10. Limitation of Liability

In no event shall Sebaste, its officers, directors, employees, or agents be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Services, even if advised of the possibility of such damages. Your sole remedy for dissatisfaction with the Services is to discontinue use.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for incidental or consequential damages, so the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Sebaste, its officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including attorney fees) arising out of or in connection with your use of the Services or any violation of these Terms.

12. Force Majeure

Sebaste shall not be liable for any failure to perform its obligations under these Terms where such failure results from any cause beyond our reasonable control, including but not limited to: electronic or communications failure, failure of third-party service providers, civil disorders, acts of terrorism, labor disputes or shortages, governmental orders, fires, floods, or other natural disasters.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of laws principles. Any disputes arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in New Mexico.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provision shall be deleted without affecting the remaining provisions.

15. Changes to Terms

Sebaste reserves the right to modify or update these Terms at any time, without prior notice. Changes become effective immediately upon posting. Your continued use of the Services after any modifications signifies your acceptance of the updated Terms.
